At Learning Portrait, LLC (“Learning Portrait”), protecting your privacy and your children’s privacy is a critical priority. Our Privacy Policy outlines how we collect, use, protect, and share your information. It covers students, parents, educators, and any other users of our websites, mobile apps, platform or related products and services (collectively, the “Service”). Any updates will be posted with revised dates and, if needed, additional notifications. We encourage regular reviews of the Privacy Policy to stay updated on our practices.
Information We Collect
We collect information to provide, maintain, and improve the Service. The types of information we collect include:
Personal Information
Teacher and school administrator names, email addresses, school/district affiliation, and account credentials.
Student names, unique identifiers (e.g., student ID numbers), email addresses (if applicable), photographs, grade level, and classroom or course enrollment.
Parent or guardian contact information (if required for consent under COPPA).
Student Work and Educational Records
Assignments, submissions, grades, teacher feedback, student self-assessments, and any files or content uploaded by students or teachers.
Messaging and Communication Data
Messages exchanged between teachers and students within the Service, including feedback notes and comments.
Information Collected Automatically
Usage and Device Information. Log data such as IP addresses, browser type, operating system, device identifiers, access times, and activity logs.

Data Use, Aggregation, and Sharing
Aggregation and Sale of Data
We do not sell or rent data with any parties outside of Learning Portrait. However, we reserve the right to sell or rent data in the future if we determine that doing so would advance the public good by improving educational knowledge. Should Learning Portrait ever decide to sell or rent data with a third party, we will provide clear notice to our users and ensure that any sharing is conducted in accordance with applicable laws and our commitment to protecting your privacy. All data sold or rented externally will be aggregated and de-identified to protect individual privacy in accordance with applicable laws and industry standards. No information will be disclosed in a manner that could reasonably be used to identify an individual student, teacher or school. Additionally, users will be notified prior to such use and will be provided with an opportunity to opt out.
Information Sharing and Disclosure
We do not sell or rent personal information except as specifically provided in this Privacy Policy. We may share information as follows:
With authorized school personnel, administrators, teachers, and (where appropriate) parents or guardians.
With third-party service providers who assist in operating, maintaining, or improving the Service (such as cloud hosting or analytics providers), under strict confidentiality and security obligations.
In connection with a merger, acquisition, or sale of all or a portion of our assets, with advance notice to affected users.
As required by law, regulation, subpoena, or court order, or to protect the rights, property, or safety of Learning Portrait, our users, or others.
With your consent or at your direction.
Legal Compliance
FERPA (Family Educational Rights and Privacy Act)
We comply with FERPA and consider ourselves a “school official” with a legitimate educational interest. We use student education records only to provide and improve the Services, and we do not disclose such records except as authorized by the educational institution or as permitted by law.
By using the Service, you confirm that (a) you have read and understand our Privacy Policy regarding the collection, use, and sharing of information; (b) if you are a Student, your parent or guardian can access all information in your account, including messages with educators and your grades; and (c) the school or Educator has obtained the necessary parental or student consent for collecting, using, and disclosing personal information as required by this Privacy Policy, FERPA, and other applicable laws.
COPPA (Children’s Online Privacy Protection Act)
If the Service is used by children under 13, we require verifiable parental consent before collecting personal information from students, unless consent is obtained by the school, school district or educational organization as part of an educational agreement. If you are installing, accessing or using the Service on behalf of a Student who is under the age of 13, you represent and warrant that (i) you are an authorized Educator who has obtained the verifiable consent of the Student’s parent or legal guardian in accordance with COPPA for the Student’s use of the Services, or (ii) you are the parent or guardian of the Student and you have provided your verifiable consent in accordance with COPPA to your Student’s Educator for your Student’s use of the Services.
SOPPA (Student Online Personal Protection Act – Illinois)
We comply with SOPPA by entering into Data Privacy Agreements with Illinois school districts as required, and by using student data strictly for educational purposes. We do not sell, rent, or use student data for targeted advertising or any non-educational purposes, except as authorized by the educational institution or as permitted by law.
ISSRA (Illinois School Student Records Act)
We comply with ISSRA by ensuring that student records are kept confidential, are accessible to parents/guardians and eligible students upon request and are only disclosed as authorized by law.
Data Security
We use industry-standard technical, administrative, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures may include:
Encryption of data at rest and in transit
Secure data storage and access controls
Regular security audits and vulnerability assessments
Employee training on data privacy and security
Despite our efforts, no security system is impenetrable. If we become aware of a data breach affecting your information, we will notify you as required by applicable law.
Data Retention

When a school or district terminates its relationship with us, we will delete or de-identify student data in accordance with contractual and legal requirements.
International Users
The Service is intended for use by U.S.-based schools and users. If you access the Service from outside the United States, you consent to the transfer and processing of your information in the United States, where data protection laws may differ from those in your jurisdiction.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify users by email or through the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Policy.
